Salary payment deadlines and why final wages differ from a full and final settlement

Full and final settlement is an administrative label for several exit-related items. It can include final wages, leave encashment, reimbursements, recoveries, gratuity and other amounts. Those items do not necessarily share one legal payment rule simply because they appear in the same spreadsheet.

For payroll teams, the important starting point is to identify wages payable and their deadline separately from the wider exit-clearance process. Waiting for every document in the settlement pack can create a wage-payment problem even when another item still needs review.

Check the wage deadline first

Section 17 of the Code on Wages sets timelines for wage payment. Its monthly-wage provision generally requires payment before the seventh day of the succeeding month, while specified exits, including resignation, attract a two-working-day wage-payment requirement. Relevant notified variations and other applicable legal timelines must also be considered. [2] [1]

This should not be shortened to a claim that every full-and-final component in every situation must be paid under one two-day rule. Review the legal character of each amount and any separate provision that governs it.

Separate the components in the exit tracker

Create distinct lines for final earned wages, approved variable earnings, leave settlement, expenses, gratuity and proposed recoveries. Record the basis, evidence, approval owner, legal deadline and payment status for each line.

Gratuity, for example, has its own framework under social-security law and the relevant rules. [3] Asset clearance is an operational task. Neither should be treated as an automatic reason to move every wage amount to a later convenient payroll cycle.

Plan for an exit between regular cycles

Suppose an employee leaves shortly after your normal payroll has closed. The next regular salary date may be weeks away. Your process should identify the wage deadline and make an authorised calculation and payment route available instead of assuming the next monthly run is always acceptable.

Keep evidence of the final working date, approved attendance, salary rate and any adjustment. Where a component is disputed, get prompt advice on how to handle that component and the undisputed amounts. Do not conceal a delay by changing the recorded exit date.

Keep approvals from becoming a bottleneck

Nominate an alternate approver for exits. Ask HR, the manager and finance to work to the legal payment requirement, not only the company’s internal clearance target. A system that requires all administrative tasks to close before calculating wages may need a separate route for timely payment.

Similarly, an employee’s acknowledgement or a portal approval should not be designed as a blanket condition that postpones statutory dues. Track acknowledgement, dispute resolution and payment as separate events where the law requires it.

Explain the settlement clearly

Give the employee a component-level statement with the earning period, deduction reasons, payment status and query contact. Reconcile the statement to payroll, bank evidence and any later settlement payment.

Payroll Advisor’s employee-lifecycle support can be scoped around this working and handover. The objective is a timely, understandable exit account with a clear owner for each unresolved item, rather than a single pending label covering everything.
