Overtime pay in India and why a managerial title does not answer every question

Overtime eligibility should not be decided by job title alone. A payroll team needs to identify the applicable law, the establishment, the employee’s position within that framework and the hours actually worked. The word manager on an offer letter is not a complete legal assessment.

The Ministry’s Labour Code clarification addresses overtime for employees whose minimum wage rate is fixed under the Code on Wages. It should be read alongside the applicable working-hours framework and rules. [1] This is why a blanket rule that all salaried staff receive no overtime can be unreliable.

Check coverage before using a formula

Record the establishment category, appropriate government and relevant employee classification. Identify the normal working day and weekly limits under the applicable provisions. The Occupational Safety, Health and Working Conditions framework and relevant state requirements may also need consideration. [3]

Do not assume one hourly divisor or one daily threshold fits every worker, shift pattern and establishment. A payroll formula should reflect an approved legal and policy configuration, with a source and effective date.

Distinguish hours worked from hours recorded

Attendance records help establish when a person was present, but presence is not always the same thing as qualifying overtime work. Reconcile shift schedules, breaks, authorised additional work and the actual records. Resolve missing or conflicting entries before the payroll cutoff.

Approval supports control of overtime, but it should not be used as a shortcut to deny a legal entitlement where qualifying work has in fact been performed. Escalate disputed cases for an appropriate decision instead of leaving payroll to guess whether a manager intended the extra hours.

Calculate using the correct normal wage basis

The Code on Wages overtime framework provides a rate of at least twice the normal wage rate for qualifying overtime. [2] Confirm how the normal wage rate is determined for the particular employee and period before applying the multiplier.

For a simplified example, assume the correctly determined normal hourly wage is ₹200 and two hours qualify for payment at twice that rate. Overtime for the example is ₹800. The example does not establish that ₹200, two hours or any particular divisor applies to your workforce.

Keep other payroll treatment separate

Overtime can affect contribution calculations and wage-definition tests. Do not assume that the treatment used for an eligibility threshold is automatically the same as its treatment in contribution wages. Maintain a component map for those different questions.

Also distinguish overtime pay from a discretionary attendance incentive or a shift allowance. Different labels may represent different payments, and renaming overtime does not resolve an underlying entitlement issue.

Make the record reviewable

Retain the date, shift, hours, rate, amount, approver and any correction reason. Show the earning period when overtime is paid later than the month worked. Reconcile the amount to the employee’s payslip and the approved input total.

Payroll Advisor can help connect approved attendance inputs to payroll working. Establishing the correct eligibility and rate configuration first makes automation useful rather than simply making a mistaken assumption run faster.
