How to check minimum wages and VDA for a business with employees in several states
Minimum-wage compliance starts with finding the correct notification for the employee and establishment. A rate copied from another employer or another state may look plausible while applying to the wrong category, location or period. Multi-state payroll therefore needs an applicability register, not just a salary column labelled minimum wage.
The Labour Code framework requires attention to the appropriate government and the applicable notified rate. Minimum wages and the statutory definition of wages are related compliance questions, but they are not the same concept. [1] [3]
Map the employee before choosing the rate
Record the employing establishment, work location, applicable employment or occupational category, skill classification and effective period. Determine whether the establishment falls in the central or state sphere for the relevant requirement. Then identify the notification and any amendments that apply.
Job titles alone can be misleading. Two companies may both use the designation executive for work with different skill requirements. Keep the reasoning for the classification and have a responsible person approve it instead of allowing the payroll processor to guess from the title.
Read the wage components and the effective date
A notification may distinguish a basic rate and a variable dearness allowance or other prescribed elements. Read the actual structure and the period to which it applies. Do not compare an annual CTC figure directly with a monthly minimum-wage figure without understanding the permitted components and units.
The 2026 Central Rules provide the central framework for wage fixation and related matters. They should not be used as a substitute for the relevant state notification where the state is the appropriate government. [2]
Test a change using a fictional example
Assume a hypothetical category has a required monthly wage amount of ₹20,000 under the applicable notification. An employee’s relevant amount is ₹18,500. A CTC worksheet showing additional employer provisions does not automatically resolve the ₹1,500 gap. The reviewer must check which components legally count and correct the shortfall where required.
This is an example of the review method, not a current rate for any Indian state. Publishing a number without its notification, category and effective date makes it difficult for readers or payroll teams to use safely.
Maintain a change register
For each notification, retain the source, publication date, effective date, affected employees and approval of the configuration update. If the effective date precedes implementation, identify the period requiring arrears and review consequential contributions and reporting.
Check that a rate change reaches the employee master, payroll calculation and cost forecast. Updating a reference table without updating the employee’s actual earnings can leave the compliance gap unchanged.
Make the monthly review manageable
Use a short exception report showing employees below the applicable threshold, missing classifications, upcoming review dates and unresolved jurisdiction questions. Keep statutory interpretation separate from data cleanup so each issue reaches the right owner.
For businesses operating across locations, Payroll Advisor can help organise the employee mapping and payroll working within the agreed compliance scope. The useful outcome is a traceable link from each employee to the rule applied, not a universal number that quickly becomes stale.
