Gratuity and employee exits · 3 MIN READ
Fixed term employee gratuity after one year and the contractor distinction
A direct fixed-term employee can have a different gratuity position from an ordinary open-ended employee. The Social Security Central Rules, 2026 address eligibility after at least one year under the contract and the subsequent period. [1] Payroll should identify that category correctly instead of applying one five-year gate to every person on the master.
At the same time, every person described internally as contract staff is not necessarily a direct fixed-term employee. The employment relationship matters more than the informal label used by a manager.
Confirm who employs the person
Read the actual employment contract, employing entity, start date, stated term and relevant renewals. A worker employed by an outside contractor and deployed to a client is not automatically the client’s direct fixed-term employee. The Ministry’s FAQs expressly distinguish the two arrangements. [2]
Keep the classification approved in the employee record. An assignment end date in a project system is not by itself a fixed-term employment contract, and a payroll code should not create a category that the underlying documents do not support.
Check the one year position
The current rules should be applied to the facts of the contract and exit. Record the service period, contract-expiry event and any other relevant circumstances. Cases involving renewals, interrupted contracts or another statutory exception need their own review rather than a simplistic date test.
A one-year condition should not be rewritten as more than one year when the applicable rule says at least one year. Equally, do not infer that every short contract creates an identical entitlement without checking the governing provision.
Keep proportional service separate from ordinary rounding
Fixed-term gratuity has a proportionate treatment that should be distinguished from the completed-year and part-year approach used in other cases. [1] Do not automatically round a subsequent fraction of a fixed-term year to the next whole year because the ordinary calculator was built that way.
For example, a direct fixed-term case lasting one year and three months needs review of the applicable proportionate service measure. The processor should not silently treat it as either exactly one year or an ordinary two-year rounded result. The approved method belongs in the calculation record.
Preserve the supporting evidence
Keep the contract, extensions, attendance or service records, final working date, wage base, calculation and approval. Record which legal framework and effective rules were applied. A later provider change should not make the basis of the decision disappear.
Where the employee disputes the category or service history, route the issue to the responsible HR and legal owner. Payroll can prepare the facts and arithmetic, but it should not resolve a disputed employment relationship through a dropdown selection.
Explain the settlement component
Show gratuity separately from final wages, leave settlement and reimbursements. Identify the service period and wage base used without publishing private employee data. Keep payment and acknowledgement records linked to the approved statement.
Payroll Advisor can support the service and payroll working within an agreed employee-lifecycle scope. Correct classification first, followed by a reviewable calculation, is the practical way to avoid applying the right formula to the wrong kind of employment.
