Old versus new tax regime and how employees should review the payroll declaration

Choosing a tax regime from one deduction or an old salary example can give an employee the wrong expectation about take-home pay. The useful comparison uses the applicable tax year, total projected income, claims actually available under each option and tax already deducted.

For income from the relevant 2026 transition, payroll must use the Income-tax Act, 2025 framework and the correct tax-year references. Earlier periods and their corrections remain subject to their appropriate framework. The Income Tax Department explains that transition in its official FAQs. [1] [2]

Start with a complete annual picture

Collect current-employer earnings, previous-employer salary, expected variable pay, taxable benefits and other information that can appropriately enter salary TDS working. Record the assumptions behind an uncertain bonus or a salary revision rather than treating an optimistic estimate as guaranteed income.

Separate amounts already earned from future projections. An employee who joined halfway through the year may still have substantial income from an earlier employer. Starting the tax forecast at zero simply because they are a new joiner can create a later shortfall.

Compare lawful claims under each option

Do not use the same exemption and deduction list for both regimes without checking the current provisions. A payment being visible on a salary structure does not establish that it receives an exemption under the employee’s selected option.

Use the current employee-claim process and supporting evidence. The Department’s Form 124 guidance explains the employee statement of claims for salary TDS, replacing the earlier Form 12BB for the relevant new framework. [3] A claim should be supported and applicable, not added merely to reduce a monthly deduction.

Look at annual tax and remaining TDS separately

An annual comparison identifies the projected tax under each eligible option. The monthly deduction also depends on what has already been deducted and how many salary payments remain. A change in monthly TDS does not always mean the tax rates changed.

For a simple arithmetic illustration, assume the correct annual tax projection is ₹72,000, ₹30,000 has already been credited in the working and six equal deduction periods remain. The remaining ₹42,000 would imply ₹7,000 per period before other relevant adjustments. These are assumed figures, not a tax-slab calculation.

Understand what the employer declaration does

The declaration guides the employer’s payroll working. The employee’s final return choice, eligibility and procedural requirements need a separate check under the applicable law. Do not assume every payroll selection either permanently binds the return or can always be changed without conditions.

Keep a record of the employee’s intimation, date and any permitted change. Explain the revised projection when a later declaration, proof review or income update changes deductions.

Review before year end

Recheck actual income and valid evidence before the final payroll cycles. Use the Department’s current-year tools and provisions for any slab or rebate comparison rather than a screenshot that omits its year or conditions.

Payroll Advisor can support the agreed declaration and salary-tax working. Employees should choose using their complete situation and obtain tax advice where needed, rather than treating a generic lowest-tax headline as a personal recommendation.
